Florida tourist tax late penalties: how they add up, and how to stop them

Last checked Oct 26, 2026 from official sources. Not tax advice.

Florida’s penalties are built to punish lateness, not just unpaid tax. Even a return with nothing due costs money if it’s late, and the interest and penalties really hurt.

The penalty rules counties publish

Penalty10% of the tax for each 30 days (or part) late, up to 50%, with a $50 minimum (Okaloosa and Bay County FAQs; Fla. Stat. 212.12 pattern).
$0 returnsLate zero returns are charged the $50 minimum (Okaloosa, Bay; Manatee says the minimum applies “even if no tax is due”).
InterestA floating rate the Department of Revenue sets each January 1 and July 1, from the due date until paid.
Collection allowanceLost. On-time filers keep 2.5% of the first $1,200 of tax (Okaloosa, Bay), or 2.5% capped at $30 a month for electronic filers (Manatee).
Beyond thatWalton’s Clerk warns of liens and other collection action, and says rental ads are checked regularly.

Why monthly matters

Because every month is its own return, one forgotten season becomes several separate late returns, each with its own minimum penalty. An owner with a quiet winter who stops filing can owe penalties for months in which no one stayed.

How to stop the clock

Questions owners ask

What is the penalty for filing Florida tourist tax late?

County FAQs (Okaloosa, Bay) list 10% of the tax for each 30 days late, up to 50%, with a $50 minimum, plus floating-rate interest and loss of the collection allowance.

Is there a penalty for a late $0 tourist tax return?

Yes. Okaloosa and Bay assess the $50 minimum on late zero returns, and Manatee says the minimum applies even if no tax is due.

Can Florida tourist tax penalties be waived?

Walton County’s Clerk says voluntary disclosure before the county contacts you results in waiver of penalty charges and minimizes interest. Ask your own county about its policy.
